ROCK HILL, S.C. -- Rock Hill police are trying to find the person who shot and killed 29-year-old Daniel Ervin Wednesday night.

The incident occurred at 940 Pebble Road.

"He had gone over to use the bathroom came back out in the yard and then people heard a pop. That gets people’s attention and he collapsed in the yard," said Captain Mark Bollinger.

"He didn't deserve to die over nothing crazy," said Cindy Dickerson, a cousin.

Ervin, along with family and friends, were planning to celebrate his birthday on Friday. Now they are planning a funeral.

"His brother passed too. So it's like too much to me because we lost a brother, and now we lost him."

Family members say Ervin's brother died from cancer four years ago.

Police say at least 20 people were outside during the incident but so far no one has been willing to tell what happened.

"Hopefully someone will come forward and help us with this case," said Bollinger.

An arrest would give the family some peace.

"Didn't nobody really know or see anything, and there was a lot of people out here, so that kind of bothers me," said the cousin.
