Suspect shot by officer has long criminal history

CHARLOTTE, N.C. -- A Charlotte-Mecklenburg police officer shot a suspected robber this morning at a fast food restaurant.

Police have identified that suspect as 25-year-old Zavier Marquis Davis.

Police responded to a robbery at the Wendy’s on Park Road at about 1:30 a.m. Investigators say Officer Orville Payne III, encountered Davis, who was armed, as he was running out of the back of the restaurant.

Investigators say that’s when Payne shot the Davis once in the leg. Davis was taken to a hospital with non-life threatening injuries and is currently in stable condition.

NewsChannel 36 reported on Davis in 2005.

From November 2001 to March 2005 Davis racked up 27 felony charges and 13 misdemeanor charges for robberies involving a number of fast food restaurants and a string of car thefts and trespassing charges.

Police are interviewing a second suspect but that person has not been arrested. Authorities say they recovered the stolen money and a gun at the scene.

Payne will be placed on administrative leave with pay, which is standard procedure in an officer-involved shooting.
