STALLINGS, N.C. -- Folks plan to turn out by the dozens Monday night in Stallings to fight the neighborhood builder M/I Homes.
They're also paying close attention to how town council members vote, saying what the builder wants isn't in the FairHaven neighborhood’s best interest.
M/I Homes wants to amend a plan for the second phase of development, which includes smaller, less expensive homes on smaller lots. That could mean an additional 12 homes or more than the original plan called for.
Neighbors say they want the larger, more expensive homes on bigger lots that they were promised and the town previously approved.
Some say that promise is why they bought in FairHaven in the first place, because the more expensive end would make their homes worth more as well.
Now, neighbors say smaller, less expensive houses M/I Homes is proposing turns phase two into the low-end of the neighborhood.
"They're devaluing and degrading this neighborhood, creating smaller lots and smaller houses that they claim they can sell faster, so they're just getting the cash and get out of here faster and not produce what was promised to both the Stallings town council and the people who purchased here since 2006,” said homeowner Joanna Alessi.
“I feel as if they pulled the wool over our eyes,” said neighbor Fran Houston.
Another concern neighbors have is when they can talk.
Every person gets three minutes during the public comment period, but the town will only let people considered experts talk during the hearing, since it's like court and there could be cross examination.
Neighbors say they can't use HOA money to pay for an attorney to fight for them but are trying to get some people approved during the quasi-judicial phase, scheduled to start at 7:47 p.m.
Council members aren’t allowed to discuss the rezoning because of the quasi-judicial nature, town officials said.
M/I Homes says it will have two people at the hearing answering questions.
