LINCOLNTON, N.C. – A former Lincoln County doctor has been charged with rape from the alleged sexual assault of a female patient 17 years ago.

Today former gynecologist John Everett Marshall, 59, walked out of the Lincoln County courthouse after his first appearance, in which he pleaded not guilty. He did not speak but attorney Blair Pettis did.

"My client asserts his innocence," he said, as reporters asked Marshall about the charges. The woman said that Marshall drugged and raped her when she was a patient at the Lincolnton Medical Center in May 1996.

"We've just finally corroborated her story through medical records and things," said Lincolnton Detective Ashley Boyles about the 12 month investigation. “It started about a year ago. We had a victim come to us and said that she was a patient of Dr. Marshall. And he drugged her while she was in his care and that's when he raped her."

Marshall’s license was indefinitely suspended in March 2011 after the board found that he improperly touched a nurse, and also failed to keep detailed records of treatments. According to the board, a nurse complained in 2009 that Marshall had made inappropriate comments to her in front of a patient. He then allegedly touched and rubbed her stomach with his hands, walked up behind her and rubbed himself against her, and followed her from room to room asking her personal questions.

Authorities encourage anyone with information about the case to contact the Lincolnton Police Department at 704-736-8900.
