Man charged with DWI in fatal crash 12 hours later

WILLIAMSTON, N.C. (AP) -- Authorities say a man suspected of drinking alcohol before a fatal wreck in Martin County was charged with driving while intoxicated about 12 hours before. 

State troopers said 33-year-old Gary James was driving 55 mph around 6 a.m. Saturday when he ran a stop sign and crashed into a truck, killing the driver and injuring his wife and son. 

The Highway Patrol says James was taken to the hospital, but they expect to charge him when he recovers. Troopers say James appeared to have been drinking before the Saturday morning crash. 

Robersonville Police arrested James around 6 p.m. Friday and charged him with DWI. They didn't immediately release details about that arrest or why James was released from custody. 

It wasn't known if James had a lawyer.
