CHARLOTTE, N.C. -- The suspect accused of driving the car that hit and killed two people over the weekend is in the country illegally, officials say.
On Tuesday, Mecklenburg County Sheriff Chip Bailey told NBC Charlotte that 23-year-old Oscar Francisco Garcia-Fuentes is an illegal immigrant.
Police said that Garcia-Fuentes was speeding in a Ford Mustang when he struck a car driven by Tony Jonquil Gabriel early Saturday morning in the intersection of Albemarle and North Sharon Amity Roads.
Brittany Chaquaina Massey and her 1-year-old son, William Perry, were also in the car.
Gabriel and Perry were killed and Garcia-Fuentes fled the scene.
On Tuesday, Garcia-Fuentes did not appear in district court because he was being interviewed by ICE agents as an illegal immigrant.
Sheriff Bailey said that if Garcia-Fuentes is convicted he would have to satisfy his sentence with the state before he is deported.
The grandfather of the 1-year-old, Fred Williams, said he forgives him for the crash, but he shouldn't have run away.
