RALEIGH, N.C. – Saturday night, Wake County Sheriff Donnie Harrison said that one person was arrested in connection to the North Carolina State Fair accident that injured five.
 

Timothy Dwayne Tutterrow, 46, of Georgia has been charged with three felony counts of assault with a deadly weapon inflicting serious bodily injury, Harrison said.
 

"After inspection of the ride, we determined that it had been tampered with and critical safety devices were compromised," Harrison said.
 

The Sheriff continued by saying Tutterrow intentionally tampered with the ride after a safety inspection was made.
 

Tutterrow is employed by an independent ride contractor. The Vortex is the only ride the company has at the State Fair.
 

The investigation is continuing and additional arrests could be made, Harrison said.
 

Three of the five victims injured remain hospitalized.
 

Those that remain in the hospital are Anthony Gorham, 29, Kisha Gorham, 39, and a 14-year-old juvenile.
