CHARLOTTE, N.C. –  A 23-year-old was arrested after police say he fled the scene of an accident early Saturday morning that killed a man and a baby boy.

Oscar Francisco Garcia-Fuentes has been charged with two counts of involuntary manslaughter and three counts of felony hit and run.

Tony Gabriel, 26, died in the accident at the intersection of Albemarle and North Sharon Amity Roads.  His back seat passenger, identified by neighbors as 18-month-old Diarre William Perry, also died.

Gabriel's front seat passenger, Brittany Massey, 24, survived with non-life-threatening injuries.  Police said she is the baby's mother.  

Witnesses told police that just after 2:15 a.m., a black Mustang convertible without its lights on sped north through a red light at the intersection.  

It crashed into the driver's side of a Mazda driven by Gabriel, who was driving west on Albemarle Road, killing him and the baby.  

Witnesses also told police they saw the driver of the Mustang jump from his car and run behind a nearby pawn shop.  Garcia-Fuentes was later identified as the driver of the Mustang, police said.

The baby's former neighbors gathered Saturday to share their grief.

"He was a beautiful little kid, wonderful, and a joyful baby," said Tyrone Grier, whose sister is the baby's Godmother.  

"She's having it real rough, all of us are -- it's a great loss," he said.
