WILMINGTON, N.C. (AP) -- The first openly gay member of North Carolina's legislature is waging a second child-custody fight with a second former partner.
Former Democratic state Sen. Julia Boseman of Wilmington is suing for joint custody of the two-year-old son born to the woman that Boseman had called her spouse.
Boseman says she has shared parenting duties and deserves parental rights despite the end of the romantic relationship.
Boseman previously carried a custody battle to the state Supreme Court before it ruled in 2010 that she could not adopt the boy born to her same-sex partner without that woman losing parental rights. Boseman's former partner sued to negate the adoption after the couple separated.
The high court ruled state law does not allow same-sex adoption, but allowed joint custody of the child.
