LINCOLN COUNTY, N.C. – The trial of Michael Segal, the man accused of murdering Delmer Sisk over a video poker machine in 2006, continued Monday morning.
Defense called Deputy Ronald Kluttz to the stand around 10:30 a.m.
Kluttz testified that when he first arrived at the crime scene in 2006, he saw Michael Segal walking toward him with his hands in the air.
He says Segal said “I shot the man. He pulled a knife on me, it was self-defense.”
During the cross-examination Kluttz told the courtroom that when they patted down Segal, officers discovered that he had on a vest.
Today's proceedings began with the defense requesting the first degree murder charges be dismissed based on “no evidence of premeditation nor deliberation.”
The defense argued that the charges should be reduced to second degree murder or manslaughter.
The state argued that premeditation can be reached in a few seconds.
All motions were denied.
