Mecklenburg DA: No Charges for Undercover Officer Involved in Deadly East Charlotte Shooting

The Mecklenburg County district attorney announced Friday that no charges will be brought against an undercover officer who shot and killed an East Charlotte man in January.

The report details how Josue Javier Diaz approached the undercover officer following a road rage incident on Albemarle Road.

According to the investigation, Diaz was armed with a .22 caliber revolver that he used, and was later recovered by police.

"I think he got a shot off, I’m not a hundred percent sure," said the officer in his report of the encounter.

Witnesses confirmed that Diaz and the officer were walking toward each other aggressively after they got out of their vehicles.

The DA concluded that the undercover officer was 'completely justified in using deadly force to stop the attack.'

Family and friends of Diaz gathered near the location of the shooting in the days after the incident in honor of his memory.

Earlier reports of Diaz's potential gang affiliation were not considered since the undercover officer was unaware of any affiliations at the time of the stop.

No charges will be filed against the involved undercover officer.
