Police believe driver in fatal accident was drinking 10:59 AM

LANDIS - A man charged with causing a wreck that killed a young mother last week in Rowan County faced a judge for the first time Thursday morning.
With an interpreter by his side, Carlos Alfonso Guillen Martinez went before a judge via video. The judge read Martinez his charges: second degree murder and driving while impaired. The judge warned the second degree murder charge carries a maximum sentence of 479 months in jail, depending on his record.

Martinez was taken into custody as soon as he was discharged from the hospital Wednesday night.
WCNC has discovered more about his criminal record. Before the judge was finished with Martinez’s first appearance, he also made him aware he had a warrant out for his arrest for probation violation under an alias, David Ortiz. Martinez said he understood all of the charges he was facing. Prior to the video appearance, Martinez had signed an affidavit requesting a court-appointed attorney. The judge appointed him Todd Paris with the public defender's office. Martinez is set for a probable cause hearing Feb. 28.
He remains in custody under a $1 million bond. Immediately following his first appearance, Martinez was driven to Central Prison in Raleigh because they have a medical unit. Martinez suffered two broken legs as a result of last week’s accident in Landis. Police said that head-on collision killed Leeanna Newman, 20, and her unborn daughter.
As we checked the criminal history of Martinez’s alias name, David Ortiz, we found several other convictions. In 2005, Martinez was convicted of driving while impaired, driving while license revoked, resisting an officer, injury to personal property, and assault on a law enforcement officer. According to court records, it also appears Martinez has used about a half dozen different aliases.
