Family sues in child's motocross death 6:55 PM

CHARLOTTE, N.C.-- The parents of 5-year-old Cody Fidler, who died last year at a Cleveland County motocross track, have filed a wrongful death lawsuit against the track's owners and promoter.

The lawsuit, which was filed in the Mecklenburg County Superior Court, alleges that the owners and promoter of Parker Valley Motocross Track neglected to enforce the track's rules and allowed an older and more experienced rider on the track while Cody was riding.

Cody was struck by a 10-year-old riding a larger motorcycle and died from a “blunt head trauma,” according to the lawsuit filed on June 27.

Wade and Michelle Fidler also claim infliction of emotional distress and deceptive trade practices in the lawsuit.

The Parker Valley track, which was owned by Charles and Juanita Parker at the time of the accident, is now closed. Joe Williams, owner of JMX Racing and former promoter of the Parker Valley track, could not be reached for comment Saturday.
