CHARLOTTE, N.C. -- Myers Park neighbors lost their battle against Queens University and the City of Charlotte Thursday when a judge ruled zoning decisions allowing new construction were accurate.

Neighbors now have 30 days to appeal, but there’s no word if that will happen.

Jean Boggs has lived on Wellesley Avenue in Myers Park for 54 years. Beautiful big homes with massive old trees on relatively quiet neighborhood streets are a few of the perks of living in the area.

"A seven-story building right in your face is not Myers Park. It's not what we expected to have in front of us,” Boggs said.

But it's there now, right out Boggs' front door. Five stories are a new parking ramp and the top two stories are dorm rooms.

Queens University of Charlotte is building a new recreation and wellness center with a gym right next to the ramp.

The Myers Park Neighborhood Association sued Queens University and the City of Charlotte, claiming the new construction and the city's zoning approval to build it exceeds density restrictions for the area.

Traffic was another major concern.

Neighbors argue Wellesley Avenue is just 20 feet wide and won't be able to handle all the cars coming from the new deck, dorm and recreation center.

The city said Wellesley Avenue, as a connector street in Myers Park, is big enough to handle it.  Wellesley is the only entrance and exit to the new buildings.

"There will be all these cars going in and out to the sports arena, all these cars going in and out to the dormitory and in and out to the parking deck with 500 parking spots.  This street was not built for that,” Boggs said.

Attorneys for Queens said the new construction meets city rules and regulations and doesn't exceed density requirements because parking ramps and dorms are considered accessory uses for the university.

Neighbors noted they're not trying to stop building construction, but they want a new entrance to the new buildings that's not on Wellesley Avenue.
