Judge declares mistrial in 2nd Hembree murder case

GASTONIA, N.C. --  The Danny Hembree trial for Randi Saldana's murder was declared a mistrial Monday afternoon.

While Hembree was testifying on the stand he said he a letter claiming to prove that he had a sexual relationship with the Assistant District Attorney.

Meanwhile, Saldana's sister was taken away from the courtroom by deputies after she ran toward Hembree screaming that he killed her sister.

"I got a conflict with you because you killed my sister," Shellie Nation said.  "Did you not say you killed me sister."

Hembree is accused of killing the 30-year-old Saldana in 2009 and then burning her body in a Kings Mountain state park. Last year, he was sentenced to death for the murder of 17-year-old Heather Catterton.

"I disagree with what was done today," said District Attorney Locke Bell.  "I disagree with the mistrial, and I still disagree with it.  But I have to live with it."
