Atlantic Beach mayor's election appeal dismissed

CONWAY, S.C. (AP) -- A state judge has dismissed the election appeal of Atlantic Beach Mayor Retha Pierce.
The Sun News of Myrtle Beach reports Circuit Judge Larry Hyman ruled Wednesday there was no impropriety in the May 22 special election in the predominantly black beach town on South Carolina's Grand Strand.
Mayor Retha Pierce and candidate Windy Price contended that Gov. Nikki Haley did not have authority to order a special election in which Pierce lost to Town Councilman Jake Evans on a 79-5 vote. Price received one vote.
The special election was called after the municipal election commission tossed out the results of last November's mayoral election. But when the commission did not set a new election in a timely fashion, the governor set a date for a special election.
