LENOIR, N.C. -- Authorities in Caldwell County have issued an arrest order for Adam Baker to face pending charges even though he returned to Australia in January.
Baker was scheduled to appear in court on Monday for failure to return rental property. Baker's attorney, Shell Pierce, said he had been in contact with the Australian Consulate as well as immigration officials and assured the court that Baker was in Australia.
The Caldwell County District attorney's office said it would not drop the charges against Baker.
Baker's 10-year-old daughter, Zahra, disappeared from the family's Hickory home in the fall of 2010, and her remains were later found scattered across Caldwell County.
Adam's wife, Elisa Baker, has been sentenced to up to 18 years in prison for the murder of Zahra.
Prosecutors said they don't think Adam Baker was involved in his daughter's death.
