MORGANTON, N.C. A Morganton man was convicted of firing into a home in December 2011 and will spend at least the next five years in prison.

Daniel Raymond Smart, 44, was convicted after a four-day trial in Burke County.

The crime originated from a dispute between neighbors and the weapon was discharged into a dwelling which at the time was occupied by two adults and two children, said District Attorney James Gaither Jr. in a statement.

Smart was sentenced to 65-90 months in prison after the jury deliberated for about two hours.

According to the Burke County Sheriff s Office, Smart shot at his neighbor s house just yards away on December 27, 2011 and then tried to burn the home down nearly four hours later.

Police were called to a family s home on Blue Ridge Ventures Road at 10:40 p.m. as a homeowner said he heard a gunshot while his family was inside the residence. Police found a bullet had entered the back of the home, went through bedroom and bathroom walls and out the front of the house.

At 2:27 a.m. officers were called back to the same home after Smart allegedly threw something against the house and started a fire, according to the police report.

Smart was not charged with the alleged arson. No one was hurt during the incident, and the house sustained minimal damage.
