CHARLOTTE, N.C. The Federal Elections Commission (FEC) is fining District 9 Congressman Robert Pittenger after he delayed reporting a substantial donation made during his campaign for congress.

NBC Charlotte obtained the letter sent to Pittenger s treasurer and campaign. Officials stated in the letter on January 16, 2013, the FEC found that there is reason to believe that Pittenger For Congress LLC and you, in your official capacity as treasure, violated by failing to file the 48 hour notices.

The FEC requires notification in writing of donations $1,000 or more within 48 hours after receiving the contribution.

The letter highlights in April of last year, Pittenger received a donation totaling $309,000. Officials with Pittenger s campaign said that Pittenger himself made the donation and although they reported it to the FEC, it wasn't reported within the 48 hour window. Despite this, the FEC is fining Pittenger $31,010.

Pittenger s FEC fine will incur penalties if the campaign doesn't pay or respond by February 25, 2013.

In a press release sent to NBC Charlotte, Pittenter s campaign said Pittenger for Congress staff will continue to discuss the matter with the FEC, including whether or not the full $31,010 fine is justified given the circumstances. Whatever the result, no donations from campaign supporters will be used to pay the fine.
