DALLAS, N.C. --- A death investigation stemming from June developed on Friday, when Gaston County police made an arrest.

Officers responded to a home in the 100 block of Outback Lane in Dallas on the morning of June 1. The original call was for a woman in cardiac arrest.

Police arrived to find Emily Lauren Upton dead in the residence.

The police department and Mecklenburg County Medical Examiner s Office have determined the cause of death to be the prescription narcotic Oxymorphone.

Investigators say Timothy Boyd Gibson, 23, provided the drug to Upton. He was charged Thursday with second-degree murder.

Upton's mother, Samantha Shaver, told NBC Charlotte, I'll never believe my daughter took anything willingly...she was more responsible than that. I just want her back and I know I can't have her back. I know that...but I want justice. I want justice for my daughter.

Upton had just finished her third year of nursing school at UNC Charlotte and was due to graduate in May 2014.

My daughter lost her life. She was 20 years old. She had her whole life ahead of her. She had so many goals and dreams, sobbed Shaver.

The investigation is ongoing. Gibson is being held on $500,000 bond.
