GASTONIA, N.C. -- The Danny Hembree trial for Randi Saldana's murder was declared a mistrial Monday afternoon.

While Hembree was testifying on the stand he said he a letter claiming to prove that he had a sexual relationship with the Assistant District Attorney.

Meanwhile, Saldana's sister was taken away from the courtroom by deputies after she ran toward Hembree screaming that he killed her sister.

I got a conflict with you because you killed my sister, Shellie Nation said. Did you not say you killed me sister.

Hembree is accused of killing the 30-year-old Saldana in 2009 and then burning her body in a Kings Mountain state park. Last year, he was sentenced to death for the murder of 17-year-old Heather Catterton.

I disagree with what was done today, said District Attorney Locke Bell. Idisagree with the mistrial, and Istill disagree with it. But I have to live with it.
